Prosecution proceedings commenced against a Wauchope quarry for breaching mining laws

The NSW Resources Regulator (the Regulator) has commenced prosecution proceedings against Macquarie Marble and Lime Pty Ltd and a Director of the company, for alleged breaches of the NSW mining legislation.

The matters relate to Mining Lease ML1446, a limestone mine located in the Broken Bago State Forest in the Port Macquarie Hastings LGA.

The Regulator alleges that Macquarie Marble and Lime Pty Ltd failed to comply with three legislative directions by failing to provide a rehabilitation plan, a rehabilitation cost estimate and failing to secure the entry points on ML1446 by the due dates.

The Regulator also alleges that the Director of Macquarie Marble and Lime Pty Ltd, a 72-year-old Coffs Harbour man, breached section 248S of the Mining Act 1992 by failing to comply with a direction to provide information and records under notice. The Director is also facing executive liability allegations that he failed to ensure the three directions issued to Macquarie Marble and Lime Pty Ltd were complied with.

The Regulator suspended operations on ML1446 on 28 June 2022.

The seven matters are set down for mention in the Port Macquarie Local Court on 3 August 2022. Each offence carries a maximum penalty of $1.1 million for corporations and $220,000 for individuals.

As the matter is now before the court, further details will not be released.
